for the use of CampingCars.net

§1 Scope of Application

1. These Terms & Conditions apply to all users of the CampingCars.net platform.

2. CampingCars.net operates an online marketplace for the sale and rental of motorhomes, campervans, and related accessories.

3. Contracts regarding vehicles are concluded exclusively between the respective seller/lessor and buyer/renter.

§2 Role of CampingCars.net

1. CampingCars.net provides the technical infrastructure for listing vehicles.

2. CampingCars.net does not become a contractual party to any agreement concluded between users.

3. CampingCars.net does not guarantee the accuracy, legality, or completeness of listings.

4. Sellers are solely responsible for complying with applicable consumer protection laws.

§3 User Registration

1. Registration may be required to publish listings.

2. Users must be at least 18 years old and legally capable.

3. All information provided must be accurate and truthful.

4. Login credentials must be kept confidential.

§4 Listings and Content

1. Users may only list vehicles they are legally authorized to offer.

2. Listings must not contain misleading, unlawful, or infringing content.

3. CampingCars.net reserves the right to remove listings that violate these Terms.

§5 Fees and Payments

1. Publishing listings may be subject to fees.

2. Prices are displayed before booking and are binding at the time of order.

3. Invoices are payable immediately unless otherwise agreed.

§6 Contract Formation Between Users

1. Purchase or rental agreements are concluded exclusively between seller/lessor and buyer/renter.

2. CampingCars.net is not responsible for payment processing, vehicle condition, delivery, or contract fulfillment.

3. Any disputes must be resolved directly between the contractual parties.

§7 Liability

1. CampingCars.net shall be liable without limitation for intent and gross negligence.

2. In cases of slight negligence, liability shall be limited to essential contractual obligations.

3. Liability for third-party content is excluded unless CampingCars.net has knowledge of unlawful activity.

§8 Obligations of Commercial Sellers

Commercial sellers must comply with all applicable legal requirements, including but not limited to:

• Full legal disclosure (Imprint)

• Withdrawal policy

• Warranty information

• VAT-inclusive pricing

• Consumer information duties under EU law

§9 Right of Withdrawal (Platform Services Only)

If consumers purchase paid services from CampingCars.net (e.g., listing upgrades), they are entitled to a statutory 14-day right of withdrawal, unless the service has already been fully performed with the consumer’s prior consent.

A separate Withdrawal Policy and Withdrawal Form will apply.

§10 Termination

1. Users may delete their accounts at any time.

2. Paid services already rendered are non-refundable unless required by law.

§11 Governing Law

1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

2. If the user is a consumer residing in the EU, mandatory consumer protection laws of their country of residence remain unaffected.
